      Samsung says I have to accept their privacy policy to continue using my phone. I have ignored that push message for like 4 years out of pure spite… I wonder what would happen if I did end up in court for some reason. I assume their lawyers would just argue that me using the phone is accepting the policy, whether I have read the policy or not.

    If it’s a free service it’s definitely not in your favor. If it’s a paid service, still most likely not in your favor.

    I always remember that case where someone got injured at Disneyland and part of their Disney plus subscription is an agreement they can’t sue Disney.

      IIRC they died(?) due to allergens in food that was supposed to be allergen free and due to their D+ subscription they waived their rights to sue (bullshit)

          That’s what Disney lawyers argued. I don’t think it actually worked out for them, but I may be wrong.

            Yeah it didn’t work, everyone saw through the bullshit. They tried to settle through arbitration and keep it out of court. But that’s because Disney lawyers are scum and will do anything to find a loophole to exploit. Also think they were more concerned about the publicity and why they wanted it settled silently.

            The ultimate settlement at court was assumed to be pathetic though for killing someone. Think final amount wasn’t publicized, but the publicized settlement record claimed the husband was seeking 50k. But I guess it can settle for higher and that was just a formality amount?

            Anyhow they probably threw chump change at him and a lifetime membership of Disney+ and discounts at the parks. Certainly bundled with a NDA agreement to not disclose the settlement agreement or they’d claw it back.

        That is so fucked up. The family should sue to have the terms stricken from the agreement and then sue for killing their person. Some jurisdictions don’t allow bullshit in the T&Cs like that.

        But also Disney has a whole department of the most expensive lawyers in the world, so they’ll probably have to find a real heavy-hitter who does pro bono work.

        Or a family member who doesn’t have D+ could sue…
